Introduction

The NE6 Scammers Invoice Policy (“Policy”) elaborates on the provisions outlined in the End User License Agreement (“EULA”) under the sections “Prohibition of Scams” and “Chargebacks and Refunds.” This Policy provides detailed procedures and strict measures New England Connect LLC (“Company,” “we,” “us,” “our”) will enforce against any user (“User,” “you,” “your”) found engaging in scams, fraudulent activities, or deceitful practices on our platform.

Purpose

The primary objective of this Policy is to maintain the integrity and trustworthiness of the New England Connect LLC platform. By clearly defining the consequences for engaging in fraudulent activities, we aim to protect our users and provide a secure environment for all transactions. This Policy ensures that users are aware of the serious repercussions of scams and the strict measures we will take to address and resolve such issues.

Definitions

  • Scam: Any deceitful practice aimed at defrauding others, including financial fraud, identity theft, false advertising, and fraudulent sales.
  • Scammer: A user who engages in scams or fraudulent activities on the platform.
  • Malicious Intent: Any deliberate action intended to harm or deceive other users or the platform.
  • User Types: Includes all users of the platform, such as vendors, booking listers, establishment listers, event listers, ticket listers, advertisers, buyers, customers, clients, contributors, delivery agents, managers, staff, and any other users.
  • NE6 Wallets: The NE6 Directory Wallet and NE6 Vendor Marketplace Wallet used for transactions on the platform.
  • Forfeiture of Funds: The loss of all funds in a user’s NE6 Wallets upon termination for engaging in scams or fraudulent activities.
  • Chargebacks: A process where a transaction is reversed, returning the funds to the buyer, typically due to disputes over fraudulent activity.
  • Refunds: The return of funds to a buyer for returned products or services not delivered as promised.
  • 1099-K Form: A tax form required by the IRS for reporting payments received by a user exceeding $600 in a calendar year.
  • Payer: The entity (such as a credit card company, bank, or payment processor) that approves or denies a chargeback request.

Prohibition of Scams

New England Connect LLC maintains a zero-tolerance policy towards any form of scams, fraudulent activities, or malicious intent. Any user found to be engaging in such activities will face immediate and severe consequences, including but not limited to termination, blocking, and banning from the platform.

Fund Forfeiture

All funds in both of the user’s NE6 Wallets will be forfeited immediately upon discovery of their involvement in scams or fraudulent activities. This forfeiture applies to funds in both the NE6 Directory Wallet and the NE6 Vendor Marketplace Wallet, regardless of the amount or origin of the funds.

Legal Actions

New England Connect LLC reserves the right to take legal action against scammers, which may include:

  • Charging the scammer for any incurred losses, including hardships experienced by scammed users.
  • Pursuing civil litigation to recover damages and legal fees.
  • Reporting the scammer to law enforcement authorities for potential criminal charges.

Jurisdiction and Legal Compliance

By registering an account or utilizing the services on our platform, you agree that any and all legal disputes, claims, or actions arising out of or related to fraudulent activities or scams will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Retention of Funds for Fraudulent Activities

In accordance with the Massachusetts Consumer Protection Act (M.G.L. c. 93A), the Massachusetts General Laws Chapter 266, Section 30 (Larceny), and the Massachusetts General Laws Chapter 93H (Data Breach Notification Law), New England Connect LLC reserves the right to retain any and all funds present in a user’s NE6 Wallet upon the discovery of fraudulent activities or scams. This retention is a measure to mitigate damages and is aligned with our commitment to maintaining a safe and trustworthy marketplace.

User Agreement and Forfeiture Clause

Agreement Upon Signup

By signing up and using the NE6 Platform, users automatically agree to the forfeiture policy. This means that any user terminated for fraud or malicious activities will lose all funds in their NE6 Wallets.

14-Day Hold Period

To ensure security, all sales on the NE6 Platform remain in users’ wallets for a minimum of 14 days after a transaction has been deposited. Withdrawal requests require approval unless the user is a verified seller.

Detailed Chargeback Process for Scammed Victims

  1. Initiation: To file a chargeback request, contact our support team via a support ticket when your logged into your main NE6 account (Create Support Ticket Here) or email support at support@newenglandconnect.com within 60 days of the transaction.
  2. Review: Initial review by New England Connect LLC within 10 business days.
  3. Notification: Notify the involved parties (buyer, seller) within 4 business days of review.
  4. Investigation: Conduct an investigation, which may include requesting additional documentation from the user, within 20 business days.
  5. Resolution: Complete the investigation and notify the user of the decision within 40 business days.
  6. Refund/Invoice Issuance: Process the refund or issue an invoice to the scammer if funds are not recoverable, within 10 business days of resolution.

Responsibility for Legal Fees

Scammer’s Liability

Scammers will be held responsible for all legal fees related to any actions taken by New England Connect LLC or scammed users. This includes but is not limited to:

  • Attorney fees
  • Court costs
  • Investigation fees
  • Additional administrative fees

Invoice Policy for Scammers, Fraudsters, and Malicious Intenters

Invoice Issuance

If funds are not recovered from the scammer’s NE6 Wallets, New England Connect LLC will issue an invoice for the owed funds. The scammer is legally bound to pay this invoice upon registration on the platform. The invoice will be due immediately upon issuance.

Grace Period and Interest

New England Connect LLC provides a grace period of no more than 60 days from the date of invoice issuance for scammers to make full payment. During this period, no interest or additional fees will be charged if the invoice is paid in full.

Interest Rates and Fees

  • Interest: A daily compounded interest rate of 0.2630136986301% (or the maximum rate allowed by law) will accrue monthly at 8% if the invoice is not paid within 60 days.
  • Late Fees: On the 61st day, all accrued interest and a $50 late fee will be added to the principal balance. This late fee will continue monthly until the invoice is paid.

Payment Plans

Scammers unable to pay the invoice in full immediately may set up a payment plan with New England Connect LLC. However:

  • Interest will continue to accrue until the invoice is fully paid.
  • A minimum payment of 5% of the total principal, plus the outstanding interest, is required monthly to avoid the $50 late fee.

Debt Collection

In accordance with platform regulations, vendors and sellers must provide their Employer Identification Number (EIN) or Social Security Number (SSN) to receive payouts to PayPal (or bank transfer/mailed check) from their NE6 Wallets. This requirement ensures that all scammers have provided identifiable information prior to any payouts.

All vendors and sellers explicitly agree to this Scammers Invoice Policy upon registration, acceptance, and posting a sellable listing on the platform. Due to the identifiable information on record, New England Connect LLC will pursue rigorous debt collection efforts against scammers.

If the invoice remains unpaid after 365 calendar days, New England Connect LLC reserves the right to sell the debt to a collection agency. The scammer will then be responsible for any additional fees or legal actions taken by the collection agency.

Tax Compliance

Any user with $600 or more worth of sales in a calendar year is required by law to submit a 1099-K form. This will necessitate providing New England Connect LLC with their Employer ID or Social Security Number. Failure to comply will result in withholding of funds exceeding $600 until the 1099-K form is completed.

User Obligations Summary

  • Prohibited Activities: No engagement in scams.
  • Forfeiture: All funds in NE6 Wallets forfeited upon scamming.
  • Legal Fees: Responsible for all related legal fees.
  • Chargebacks/Refunds: Subject to automatic chargebacks and refunds.
  • Debt Payment: Immediate payment of invoices for owed funds.
  • Interest/Late Fees: Daily compounded interest and monthly late fees after 60 days of non-payment.
  • Tax Compliance: Submit 1099-K form for sales over $600/year.
  • Parental Supervision: Users under 18 must have guardian permission and supervision. The platform holds no legal responsibility for underage use of services.
