New England Connect USA’s Booking Sales and Management Terms and Conditions

Note: This policy accompanies New England Connect LLC’s Terms and Conditions, Privacy Policy, End User License Agreement, Returns and Refunds Policy, and other policies found in the “Policies” area.

Welcome to the collection of websites operated by New England Connect LLC, referred to collectively as “The NE6 Platform.” This includes:

These Booking Sales and Management Terms and Conditions (“Terms”) outline the provisions governing the use of booking sales and management services offered by New England Connect LLC (“we,” “us,” “our”). By listing an event or making a booking through New England Connect LLC, you, the user, agree to comply with these Terms, our Privacy Policy, and any other applicable policies, rules, or guidelines issued by us. These Terms form a binding contract between you and New England Connect LLC. Users are encouraged to read these Terms carefully and seek legal advice if necessary before agreeing.

New England Connect LLC acts solely as a platform provider facilitating hospitality booking services between Listing Owners and Customers. New England Connect LLC is not responsible for the management, accuracy, quality, or safety of any booking listings or accommodations provided by the Listing Owner. All legal, operational, and customer service responsibilities lie solely with the Listing Owner.

Definitions

  • New England Connect LLC: Refers to the Events and Establishments Social Directory website at https://newenglandconnect.com and its associated platforms, including the Support Knowledge Base at https://support.newenglandconnect.com and Multi-Vendor Marketplace at https://marketplace.newenglandconnect.com.
  • Booking: The reservation made by a Customer for accommodation or events through New England Connect LLC.
  • Booking Details: The details provided by the Customer when making a Booking, including dates, number of guests, and specific requirements.
  • Customer: The individual making the Booking.
  • Establishment: The property or venue listed on New England Connect LLC.
  • Booking Listing Owner: A user who has created a bookable listing on our Platform.
  • Service Fees: Fees charged by New England Connect LLC for services rendered.
  • Commission Fees: Fees charged to the Listing Owner based on the booking transaction, ranging from 0% to 15%, depending on the nature of the establishment or event.
  • Booking Plugin: The software integrated into New England Connect LLC that allows for booking management.
  • Payment Gateway: The systems used to process payments on New England Connect LLC, including PayPal and Stripe.

This directory serves as a resource for locals seeking information on community happenings, school events, and more. Members can share reviews and experiences, fostering community engagement and connectivity while boosting visibility for local businesses and talent.

Creating and Managing Listings

Listing Packages: Listing Owners must purchase a listing package that includes the booking feature.
Is Bookable Option: To enable booking management functionalities, the Listing Owner must select the ‘Is Bookable’ option on the listing page.

Required Information:

  • Establishment name and description
  • Category and tag
  • Valid address within the six states of New England, USA
  • Cancellation policy
  • Multiple Units: For establishments with multiple rooms or units, the Listing Owner must select the “Has multiple units?” option and specify the number of rooms or units.
  • Approval and Management: Upon approval, the Listing Owner can manage bookings through the “Setup Bookings” functionality on the listing page.
  • Compliance: Listing Owners must ensure that their listings comply with all applicable local, state, and federal laws and regulations.

Listing Owners are fully responsible for ensuring that their property or accommodation complies with all relevant health, safety, zoning, and legal regulations. New England Connect LLC does not verify the legality of any listings and disclaims any liability related to non-compliance or illegal bookings.

Customer Interactions

Booking Process: Customers can make bookings by selecting the room or unit from the dropdown menu on the listing page, specifying check-in and check-out dates, and providing their contact details.

Reservation Hold: The booking is reserved for 15 minutes to prevent double bookings. If payment is not completed within this timeframe, the slot will become available again.

Booking Policies:

  • How to Make a Booking:
    • Select the Room or Unit from the dropdown menu on the listing page.
    • Choose check-in and check-out dates.
    • Provide a valid contact number and the number of guests.
    • Select ‘Reserve’ and complete the checkout form with billing information and payment details.
  • Information Required:
    • Room or Unit selection
    • Check-in and check-out dates

  • Booking Confirmation:
    • Upon payment completion, a Reservation and Invoice will be sent to the registered email.
    • Users can view bookings in the ‘My Account’ section under ‘My Bookings’.
  • Accuracy of Information: Customers are responsible for ensuring that all information provided during the booking process is accurate and complete.

Customers are responsible for ensuring the accuracy of all information provided during the booking process, including but not limited to check-in and check-out dates, guest numbers, and any special requests. New England Connect LLC disclaims liability for any issues arising from incorrect or incomplete information provided by the Customer.

General Mailed Payments Policy:

  • Mailed payments are generally not accepted; however, exceptions may be made. Under no circumstances shall payments be made directly to the seller or vendor off of the NE6 Platform. For appropriate processing and tracking, all mailed payments must be sent to:
    • New England Connect LLC
    • Attention: Invoicing
    • PO Box 2045
    • Framingham, MA 01701
  • Payment Due: Full payment is required upon booking.
  • Deposits or Advance Payments: Full payment is required upon booking.
  • Refund Policy: Determined by the Booking Listing Owner and may be influenced by additional Terms & Conditions.
    • A fixed booking service fee of 3% is included in the total amount and is non-refundable.
    • For specific details relating to refunds, users are directed to the Refund Policy.
  • Payment Disputes: Any disputes regarding payments must be reported to our support team within 30 days of the transaction.

Booking Fees

Customer Booking Fee:

Customer Booking Fee: A non-refundable 3% booking service charge is included in the total booking amount and is payable by the Customer. This fee is retained by New England Connect LLC and is not subject to refund under any circumstances.

Commission Fee Charged to Booking Listing Owners: The Listing Owner pays a commission fee ranging from 0% to 15%, depending on the nature of the listing. NE6 covers payment processing fees on behalf of the Listing Owner. The current commission rates can be found at NE6 Fee Schedule Policy.

Cancellations and Refunds

Cancellation Policies:

  • 1 Day 100:0 – If canceled at least 1 day before (24 hours), then refund 100%, else refund of 0%.
  • 1 Day 100:50 – If canceled at least 1 day before (24 hours), then refund 100%, else refund of 50%.
  • 2 Days 100:0 – If canceled at least 2 days before (48 hours), then refund 100%, else refund of 0%.
  • 2 Days 100:50 – If canceled at least 2 days before (48 hours), then refund 100%, else refund of 50%.
  • 3 Days 100:50 – If canceled at least 3 days before (72 hours), then refund 100%, else refund of 50%.
  • 5 Days 100:75 – If canceled at least 5 days before (120 hours), then refund 100%, else refund of 75%.
  • 7 Days 100:75 – If canceled at least 7 days before (168 hours), then refund 100%, else refund of 75%. 

Notice Required for Cancellation:

  • No advance notice required, but 24 hours is recommended for courtesy.
  • Confirm additional cancellation guidelines with the Booking Listing Owner.
  • Cancellation Fees:
    • The fixed booking service fee of 3% is non-refundable.
  • Refund Conditions:
    • Determined by the guidelines on the booking listing page or at the discretion of the Booking Listing Owner or New England Connect USA.

New England Connect LLC is not primarily responsible for enforcing or mediating disputes regarding cancellation or refund policies, as these are determined solely by the Listing Owner. However, if a resolution cannot be reached between the Customer and the Listing Owner, both parties agree that New England Connect LLC may intervene to facilitate a resolution. In such cases, New England Connect LLC will take over the dispute process. NE6’s decision in mediated disputes will be binding as part of the platform’s resolution process. However, this does not waive the parties’ rights to pursue arbitration or court action under applicable law if they believe NE6’s resolution violates their legal rights.

By using the platform, both the Customer and the Booking Listing Owner agree to adhere to NE6’s standard dispute resolution process. NE6 reserves the right to charge an administration fee for managing the dispute, which may be deducted from any refunds processed as part of the resolution. NE6 retains the non-refundable 3% service fee regardless of the outcome of the dispute.

Amendments to Bookings

Modification of Bookings:

  • Customers must contact the Booking Listing Owner directly to make changes. 

Fees or Conditions for Changes:

  • New England Connect USA waives fees for booking modifications.
  • Booking listing owners may impose charges or conditions, as outlined in the booking listing.

Liabilities and Responsibilities

Business Liabilities:

  • New England Connect LLC and its directors, employees, or agents are not liable for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from the use of the services. Liability is limited to the lesser of the amount paid by you in the six months prior to the cause of action or $1,000.00 USD. Customer Responsibilities:
  • Customers agree to defend, indemnify, and hold New England Connect LLC harmless from any loss, damage, liability, claim, or demand made by any third party due to or arising out of their contributions, use of services, breach of terms, or violation of rights. Force Majeure:
  • No party shall be liable for failure or delay in fulfilling obligations due to events beyond their control, including acts of God, natural disasters, war, government actions, strikes, pandemics, and other similar events.

New England Connect LLC is not liable for any issues, disputes, or claims arising from the use of the accommodation or services booked through the platform. All bookings are made directly between the Customer and the Listing Owner, and any issues related to the booking, including safety, quality, availability, or compliance with local regulations, must be addressed with the Listing Owner directly.

In addition to the terms already outlined in the Force Majeure clause, New England Connect LLC is not responsible for refunds, rescheduling, or any claims arising from force majeure events such as natural disasters, pandemics, government-imposed restrictions, or other circumstances beyond the control of the parties involved.

By using the New England Connect LLC platform, both Listing Owners and Customers agree to indemnify and hold harmless New England Connect LLC from any claims, disputes, or damages arising from or related to the use of the booking services, including but not limited to property damage, personal injury, or regulatory violations. NE6 will not be held liable for any actions or omissions by either party in connection with the booking transaction.

Miscellaneous

Governing Law and Jurisdiction: The terms and services are governed by the laws of the Commonwealth of Massachusetts. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Worcester County, Massachusetts. The prevailing party in any legal action shall be entitled to reasonable attorneys’ fees and costs. Dispute resolution is outlined in our Terms and Conditions.

Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Assignment: You may not assign your rights or obligations under these Terms without the prior written consent of New England Connect LLC. New England Connect LLC may assign its rights and obligations under these Terms to a third party at its discretion. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and assigns.

Indemnity: You agree to indemnify, defend, and hold harmless New England Connect LLC, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the New England Connect LLC platform, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

Disclaimer: New England Connect LLC makes no express or implied warranties or representations with respect to the booking sales and management services or your potential to earn income from the use of the New England Connect LLC platform. In addition, New England Connect LLC makes no representation that the operation of the platform will be uninterrupted or error-free, and New England Connect LLC will not be liable for the consequences of any interruptions or downtime. All warranties, whether express or implied, are hereby disclaimed. New England Connect LLC will not be liable for any damages that you or any third party may incur as a result of your use or misuse of our platform or loss of any data. In jurisdictions that limit or do not allow these exclusions, our maximum liability will not exceed any amounts paid to you within the previous three (3) payment cycles. 

Amendments: We reserve the right to amend these Terms at any time. Any changes will be notified through the website, and continued use of the platform signifies acceptance of the revised Terms.
