Event Ticket Sales and Management Terms and Conditions

Note: This policy accompanies New England Connect LLC’s Terms and Conditions, Privacy Policy, End User License Agreement, Returns and Refunds Policy, and other policies found in the “Policies” area.

Welcome to the collection of websites operated by New England Connect LLC, referred to collectively as “The NE6 Platform.” This includes:

Introduction

These Ticket Sales and Management Terms and Conditions (“Terms”) govern your use of the ticket sales and management services provided by newenglandconnect.com (“we,” “us,” “our”). By creating an event listing or purchasing a ticket through newenglandconnect.com, you agree to comply with these Terms, our Privacy Policy, and any other applicable policies, rules, or guidelines. New England Connect LLC is not responsible for the management, execution, or quality of any event listed on the NE6 platform. NE6 solely provides a platform to facilitate ticket sales and event awareness. All aspects of the event, including safety, compliance, and execution, are the sole responsibility of the event host.

Definitions

  • Event Listing: A listing created by a user to promote and sell tickets for an event.
  • Ticket Seller: A user who lists tickets for sale on newenglandconnect.com.
  • Ticket Buyer: A user who purchases tickets through newenglandconnect.com.
  • Booking Commission Fee: A non-refundable fee charged to the Ticket Seller for each ticket sold, set at a flat 8% of the ticket price as of September 1, 2024.
  • Service Fee: A non-refundable fee included in the total ticket price, charged to the Ticket Buyer. This is set at $1 per paid ticket, with no fee for $0 tickets.
  • QR Ticket: A scannable ticket issued to the Ticket Buyer upon purchase.

Account Registration

Users must create an account to list or purchase tickets. Account details must be accurate and updated as necessary. Users are responsible for maintaining the confidentiality of their account credentials and all activities under their account.

Event Listings and Ticket Management

Creating Event Listings 

Ticket Sellers must provide the following details when creating an event listing:

  • Name of the event
  • Date and time of the event
  • Description of the event
  • A category
  • A tag
  • Location within the six New England states
  • Number of tickets available
  • Contact information and payment details

NE6 does not verify the accuracy of the information provided in event listings, including but not limited to event descriptions, dates, and locations. All details are provided by the event host, and NE6 disclaims any responsibility for inaccuracies, omissions, or misrepresentations in these listings.

The event host is fully responsible for ensuring that the event complies with all local laws, regulations, and ordinances, including obtaining the necessary permits and ensuring the venue is safe. New England Connect LLC does not verify compliance and disclaims any liability for non-compliant events.

Managing Tickets 

Ticket Sellers can manage their event tickets through the ‘Ticket Management’ button on the event listing page. This feature includes:

  • Types: Adding and managing different ticket types (e.g., Free, VIP, General Admission).
  • Sales: Viewing and resending sold tickets, and processing refunds.
  • Reports: Generating sales reports with pie charts for visual representation.
  • Scanner: Scanning QR tickets or entering ticket numbers manually for event entry. Only the Ticket Seller has access to this feature and must log in on multiple devices if multiple scanners are needed.

Purchasing Tickets

Process 

Ticket Buyers select the desired ticket type, provide contact information and payment details, and complete the purchase. Upon successful payment, a QR ticket and invoice are sent to the buyer’s email.

Viewing Tickets 

Ticket Buyers can view their purchased tickets and invoices in their account under the ‘My Tickets’ section.

Fees, Cancellation and Refund Policy

Fees

Sold tickets have a 8% commission, which is paid for by the event host.

Ticket purchasers pay a $1.00 fee per ticket purchase (excluding free tickets).

All payment processing fees are paid by New England Connect LLC.

Cancellation by Ticket Sellers 

Ticket Sellers must notify newenglandconnect.com and ticket buyers immediately if an event is canceled. newenglandconnect.com reserves the right to retain the Ticket Commission Fee (8% of the total ticket sale) even if the tickets are refunded.

Refunds 

Refunds are at the discretion of the Ticket Seller and must comply with the cancellation policy chosen during event listing. newenglandconnect.com facilitates refunds but may retain the Ticket Commission Fee.

Customer Cancellations 

Ticket Buyers must contact the Ticket Seller directly for cancellations. Refunds depend on the cancellation policy set by the Ticket Seller.

New England Connect LLC is not liable for any disputes regarding refunds or event cancellations. Ticket buyers must contact the event host directly for cancellations and refund requests, and all policies regarding refunds are determined by the event host. NE6 is not responsible for enforcing refund policies or mediating disputes between buyers and sellers.

New England Connect LLC is not primarily responsible for enforcing or mediating disputes regarding cancellation or refund policies, as these are determined solely by the Listing Owner. However, if a resolution cannot be reached between the Customer and the Listing Owner, both parties agree that New England Connect LLC may intervene to facilitate a resolution. In such cases, New England Connect LLC will take over the dispute process. NE6’s decision in mediated disputes will be binding as part of the platform’s resolution process. However, this does not waive the parties’ rights to pursue arbitration or court action under applicable law if they believe NE6’s resolution violates their legal rights.

By using the platform, both the Customer and the Listing Owner agree to adhere to NE6’s standard dispute resolution process. NE6 reserves the right to charge an administration fee for managing the dispute, which may be deducted from any refunds processed as part of the resolution. NE6 retains all non-refundable service fees regardless of the outcome of the dispute.

User Conduct

Users must comply with all applicable laws and newenglandconnect.com policies. Inappropriate or illegal event listings are strictly prohibited.

Limitation of Liability

The NE6 Platform is not liable for any indirect, incidental, or consequential damages arising from the use of the ticketing services. Our liability is limited to the amount paid by the user in the past 12 months or $100, whichever is less.

By attending an event listed on the NE6 platform, you acknowledge that New England Connect LLC is not responsible for any injuries, damages, or losses arising from the event. All risks associated with attending the event, including personal injury, property damage, or illness, are assumed by the attendee. Event hosts are responsible for ensuring the event complies with safety regulations and relevant laws, and NE6 disclaims all liability arising from the event.

In the event of a Force Majeure (e.g., acts of God, natural disasters, pandemics, strikes, government restrictions), New England Connect LLC will not be held responsible for any failure to provide services or delays in the ticketing process. The event host is solely responsible for handling any disruptions to the event caused by such circumstances.

Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration as outlined in the NE6 Terms and Conditions Dispute Resolution section.

All disputes will be resolved on an individual basis, and you agree not to bring any claims as part of a class action, consolidated action, or representative proceeding. NE6’s liability in any dispute will remain limited as specified in this agreement.

Amendments

NE6 may amend these Terms at any time. Users will be notified of significant changes and continued use of the services constitutes acceptance of the new terms. Please note that customer ticket fees and seller commissions can change with a 30-day notice.

Prohibited Items for Listing

Prohibited Items Statement

While listing the following items for sale or advertising on the NE6 Platform is prohibited, events that contain the following prohibited listing items may be acceptable if they comply with local, state, and federal law and do not go against NE6 Platform policies. Events can include prohibited listing items if they are conducted in a compliant manner. It is the responsibility of the event host to ensure that all aspects of the event adhere to applicable laws and NE6 policies.

The following items are prohibited for listing on the Platform:

  • Links to external websites, unless otherwise approved 
  • Pirated product and/or material 
  • Copyrighted or trademark materials (media, images & texts) 
  • Inappropriate body parts and organs (PG-13 maximum please) 
  • Counterfeit Items (replicas or imitations of products and designer items) 
  • Fake or Altered Documents 
  • Illegal Goods and Services 
  • Personal Information about another individual 
  • Prescription drugs and products that require a prescription 
  • Food items that have been made in a home-kitchen or an unregulated kitchen 
  • Supplements, drugs, and items that the FDA has issued a warning or recall (or) that do not meet minimum packaging label requirements by the USDA, FDA, and FTC 
  • Prostitution or Escorting 
  • Currency Exchanges or Crypto Currency 
  • Similar (or same) content several times in different categories and/or shops 
  • Miscategorization – all items must be listed in an appropriate category 
  • Meaningless title & description with no item/service 
  • Shop test items 
  • Free items and items with misleading prices 
  • Items that are not for sale 
  • Pre-order items, unless pre-sale approval proof can be provided 
  • Illegal weapons, firearms & ammunition, stun guns, bb guns, pellet guns, blowguns, dart guns, illegal knives, and slingshots 
  • Toy weapons, fake or prop weapons, 3D printed weapons, design schematics to print or self build weapons, and similar items representing weapons. This does not apply to certain items such as but not limited to kitchen knives, scissors, archery bow and arrows, etc. 
  • Bullets (of any kind), firearm parts, stun gun parts, bb gun parts, and pellet gun parts
  • Tobacco, cigars, nicotine, e-cigarettes, cartridges for e-cigarettes, e-liquid, other smoking-cessation devices, vaporizers and diffusers used for any type of smoking or oral inhalation, any smoking device or smoking related item unless the item is a collectible item or approved (such as smoking pipes)
  • No illegal animals, exotic insects/plants/feed, or live animals; certain live feed may be approved such as but not limited to crickets, worms, etc. 
  • Items made from wild or exotic animal skins (even if farm raised) and taxidermy items of wild or exotic animals; including, but not limited to any animal endangered or threatened under the US Endangered Species Act or anywhere else illegal. This includes but is not limited to exotic/wild/endangered pets, bones, furs, skins, bone/fur/skin/carcass cleaning, etc.; taxidermy items listed must be legal in all world regions. Taxidermists are encouraged to use https://marketplace.newenglandconnect.com, however it remains the taxidermist’s responsibility to ensure you’re in compliance with all world law. 
  • Items from dropship service networks, unless verified by https://marketplace.newenglandconnect.com and approved with proof of dropship contract 
  • Mod chips, mod chips accessories or other devices designed to circumvent copyright protection
  • Alcohol, Illegal drugs, controlled substances and related accessories. Certain accessories may be approved such as but not limited to smoking pipes (glass, stone, wood, etc.) 
  • Signal jammers or products that descramble cable and satellite signals 
  • Coupons and vouchers; unless it is a collectible item or otherwise approved
  • Falsified orders to create or generate false feedback. All orders must be placed by an actual buyer only
  • Setting minimum purchase requirements (for minimum quantity or amount) unless an auction, groupbuy, or rental listing 
  • Lottery tickets, fast-food game pieces, codes and coupons for sweepstakes, raffles, or drawings offering a chance to win something 
  • Resale of any tickets (event or otherwise) for events you are not authorized to be selling on behalf of.

COVID-19 Policy 

COVID-19 WARNING: Attending events where people gather can expose you to COVID-19, a highly contagious disease that may result in severe illness or death. By participating in such events, you assume all risks associated with the potential exposure to COVID-19 or any other communicable diseases. You voluntarily waive all claims against New England Connect LLC, Event Providers, and their affiliated entities regarding any such exposure.

In addition to COVID-19, attending any event may expose you to other health risks. By attending, you assume responsibility for your health and safety and release New England Connect LLC from any claims related to illness or injury at the event. NE6 does not ensure event hosts’ compliance with health regulations.

Please note that while some events on the Site may be appealing to children, the Site is not intended for users under the age of 18. We strongly encourage parents and guardians to monitor their children’s online activities. By using the Site, you affirm that you are at least 18 years old.

1099-K Form and Tax Compliance

Any user with $600 or more worth of sales in a calendar year is required to fill out a 1099-K form. This necessitates providing New England Connect LLC with their Employer ID or Social Security Number, as required by law for tax and reporting purposes. Any funds over $600 will not be paid out unless the 1099-K form is completed. For more information on this process, please visit the IRS website or consult your tax advisor.
