New England Connect USA’s Terms and Conditions for the Sale of Advertising

Note: This policy accompanies New England Connect LLC’s Terms and Conditions, Privacy Policy, End User License Agreement, Returns and Refunds Policy, and other policies found in the “Policies” area.

Welcome to the collection of websites operated by New England Connect LLC, referred to collectively as “The NE6 Platform.” This includes:

These Terms and Conditions for the Sale of Advertising (“Terms”) govern your purchase and use of advertising services provided by New England Connect LLC (“we,” “us,” “our”). By purchasing an advertisement through New England Connect USA (“the Website”), you agree to comply with these Terms, our Privacy Policy, and any other applicable policies, rules, or guidelines.

Definitions

  • Ad: Any advertisement provided by the Advertiser.
  • Advertiser: The entity or individual purchasing advertising space.
  • Advertising Materials: Artwork, copy, or active URLs for Ads.
  • Affiliate: Any entity directly or indirectly controlling, controlled by, or under common control with another entity.
  • CPC Deliverables: Deliverables sold on a cost-per-click basis.
  • CPD Deliverables: Deliverables sold on a cost-per-day basis.
  • CPM Deliverables: Deliverables sold on a cost-per-thousand-impressions basis.
  • Deliverable: Inventory delivered by New England Connect LLC (e.g., impressions, clicks, or other desired actions).
  • Insertion Order (IO): A mutually agreed order placed through the advertiser’s advertising dashboard, specifying the terms for delivering Ads.
  • Media Company Properties: Websites owned, operated, or controlled by New England Connect LLC.
  • Network Properties: Websites on which New England Connect LLC has a contractual right to serve Ads but are not owned or controlled by them.
  • Policies: Advertising criteria or specifications made available, including content limitations, technical specifications, privacy policies, user experience policies, and other guidelines.
  • Representative: Any director, officer, employee, consultant, contractor, agent, and/or attorney of an entity or its Affiliates.
  • Site: Media Company Properties and Network Properties.
  • Third Party Ad Server: A third-party entity that serves and/or tracks Ads.
  • New England Connect USA: Refers to the website and its associated platforms, including support.newenglandconnect.com and marketplace.newenglandconnect.com.
  • NE6 Advertising and Community Engagement Policy: Guidelines supporting ethical and community-aligned business promotion while driving local economic growth.

Advertising Policies

How to Purchase Advertising
Advertisements can be purchased directly through our website by selecting the desired ad package, providing the required information, and proceeding to checkout.

Information Required:

  • Business name
  • Contact person
  • Contact email and phone number
  • Advertising package selected
  • Ad content and media files (if applicable)
  • Desired start and end dates for the ad campaign

Ad Content Requirements

  • All ad content must comply with our content guidelines and community standards.
  • We reserve the right to reject any ad content that is deemed inappropriate or violates any laws or regulations.
  • Advertising that does not comply with our guidelines and community standards will not be refunded; however, it can be updated to comply.
  • Ads will be placed on a first-come, first-served basis.
  • Ad placement and type are decided at the time of ad creation, and all ads are run off the same servers as the rest of the platform.
  • Notification of any material changes to the site that could affect ad placement will be posted on the website.
  • Advertisers are required to establish guidelines for ad placements to avoid content promoting pornography, violence, etc., to maintain a family-friendly environment.

General Mailed Payments Policy:
Mailed payments are generally not accepted; however, exceptions may be made. Under no circumstances shall payments be made directly to the seller or vendor off of the NE6 Platform. For appropriate processing and tracking, all mailed payments must be sent to:

  • Payment Due: Full payment is required at the time of purchase.
  • Deposits or Advance Payments: Full payment is required at the time of purchase.
  • Non-payment Consequences: Failing to pay an ad invoice will result in the ad not running.

Advertising Fees

  • Advertising Packages: Various packages are available with different pricing based on the duration and placement of the ads. We offer three ad versions: pay per click, pay per impression, or duration.
  • Custom Packages: Custom packages can be arranged upon request.

Cancellations and Refunds

  • Cancellation Policy: Advertisers may cancel their ads at any time by contacting our support team or by deleting the advertisement from their ad dashboard. Refunds are at the discretion of New England Connect LLC. Ad campaigns are not refundable once the ad has been approved and has started, with a minimum of 24 hours’ cancellation notice.
  • Notice Required for Cancellation: At least 24 hours’ notice is required for cancellations.
  • Refund Conditions: Refunds will be assessed on a case-by-case basis and are not guaranteed. An administrative fee of up to 5% may apply if a refund is requested more than 90 days after ad invoice payment. We suggest users not pay for ads more than 90 days in advance of the ad campaign start date.

Amendments to Advertising Orders

  • Modification of Ads: Advertisers can request changes to their ads by contacting our support team or managing their ads directly in the Advertising Dashboard by selecting the title of the Ad. Changes are subject to approval and may incur additional fees.
  • Fees or Conditions for Changes: Any additional fees or conditions will be communicated at the time of the request.

Liabilities and Responsibilities

  • Business Liabilities: New England Connect LLC and its directors, employees, or agents are not liable for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from the use of the advertising services. Liability is limited to the lesser of the amount paid by you in the six months prior to the cause of action or $1,000.00 USD.
  • Advertiser Responsibilities: Advertisers agree to defend, indemnify, and hold New England Connect LLC harmless from any loss, damage, liability, claim, or demand made by any third party due to or arising out of their ad content, use of services, breach of terms, or violation of rights.
  • Force Majeure: No party shall be liable for failure or delay in fulfilling obligations due to events beyond their control, including acts of God, natural disasters, war, government actions, strikes, pandemics, and other similar events.

Introduction: NE6 (New England Connect) is designed to empower local businesses, foster community engagement, and drive economic growth throughout the New England region. As a regional platform focused on local businesses and community projects, NE6 provides advertising services that support ethical, transparent, and community-aligned business promotion.

Discrimination-Free Advertising Practices

  • NE6’s Commitment: NE6 believes in promoting inclusivity and fairness. All advertisements must align with these values by ensuring that no ad discriminates or encourages discrimination based on personal attributes such as race, ethnicity, religion, gender, sexual orientation, age, disability, or family status.
  • Prohibited Actions:
    • Ads must not intentionally target or exclude specific groups in a discriminatory manner.
    • Advertisers must ensure their ads comply with anti-discrimination laws, particularly for industries like housing, employment, and credit.
  • Special Consideration for Housing, Employment, and Credit Ads:
    • NE6 requires that advertisers promoting housing, employment, or credit opportunities clearly follow fair opportunity standards. For housing or job-related ads, users must post directly on the NE6 platform’s job or housing sections, ensuring equal visibility for all applicants.
    • Additional Guidance: Advertisers promoting housing, employment, or financial services must follow U.S. federal laws, such as the Fair Housing Act, the Equal Employment Opportunity Act, and related consumer protection regulations. NE6 supports compliance by encouraging users to display the “Equal Opportunity” logo when applicable.

Ads Related to Financial Products and Services

  • What Ads Are Covered:
    • Ads promoting credit cards, business loans, personal loans, or mortgage loans.
    • Debt recovery, consolidation, and relief services.
    • Long-term financing options or investment opportunities.
  • What Ads Are Prohibited:
    • Ads promoting quick-money schemes, pyramid schemes, or fraudulent investment offers.
    • Misleading financial advice or services that encourage unsound financial decisions.
    • Requirements: All financial service ads must include clear terms and conditions to avoid misleading customers.

Employment Ads

  • Permitted Employment Ads:
    • Full-time, part-time, and freelance job opportunities.
    • Internships, apprenticeships, and certification programs.
    • Promotions for job fairs, company perks, or guaranteed interviews.
  • Prohibited Practices:
    • Ads that promise employment guarantees or exaggerate job benefits without factual backing.
    • Job postings that redirect users to external websites, bypassing NE6’s job board.
    • Advertisers are encouraged to follow local labor laws and provide non-discriminatory job postings that ensure fair opportunities for all applicants.

Housing-Related Advertisements

  • Examples of Permitted Housing Ads:
    • Ads for the sale, rental, or lease of residential properties.
    • Services related to homeowners’ insurance, mortgage loans, or real estate appraisals.
    • Ads for home improvement services, mortgage refinancing, or rental insurance.
  • What Is Not Allowed:
    • Discriminatory ads that exclude potential renters or buyers based on personal attributes.
    • Housing ads that misrepresent the terms of rental or sale agreements.
    • Advertisers should include clear terms and disclaimers to align with local housing laws and may add the Equal Housing Opportunity logo when appropriate.

Political and Social Issue Ads

  • Permitted Social Issue Ads:
    • Ads promoting non-partisan “Get Out the Vote” campaigns or community engagement activities.
    • Local advocacy ads that support environmental, public health, or education efforts.
  • Prohibited Political Ads:
    • Ads advocating for a specific political candidate, party, or electoral outcome.
    • Ads that attempt to influence legislation outside of community or local governance.

Social Issue Ads

  • Permitted Social Issue Ads:
    • Ads promoting awareness campaigns on local health, education, or environmental matters.
    • Fundraising or advocacy ads that align with community standards and encourage civic participation.
  • Prohibited Content:
    • Ads that attempt to influence divisive political or legislative outcomes, especially those outside the scope of local community engagement.
    • Ads that misrepresent facts or promote false information related to social issues.

Prohibited Categories of Advertising

Certain categories of advertising are prohibited on NE6 unless express permission is granted by NE6 administrators. These include:

  • Financial Products: Ads promoting speculative or risky financial products without transparent terms.
  • Credit Opportunities: Ads related to credit cards, loans, or debt relief services without clear consumer protections.
  • Political Campaigning: Ads promoting candidates, political parties, or election outcomes.
  • Employment and Housing Ads: Any employment or housing ad that does not comply with anti-discrimination laws or redirects applicants away from the NE6 platform.

NE6 reserves the right to reject any ad that falls outside the platform’s values of transparency, fairness, and community engagement.

Prohibited Ad Content and Resale of Tickets

  • Prohibited Ad Content:
    • Links to external websites, unless otherwise approved
    • Pirated product and/or material
    • Copyrighted or trademark materials (media, images & texts)
    • Inappropriate body parts and organs (PG-13 maximum)
    • Counterfeit Items (replicas or imitations of products and designer items)
    • Fake or Altered Documents
    • Illegal Goods and Services
    • Personal Information about another individual
    • Prescription drugs and products that require a prescription
    • Food items, supplements, drugs, and items that the FDA has issued a warning or recall or that do not meet minimum packaging label requirements by the USDA, FDA, and FTC
    • Prostitution or Escorting
    • Currency Exchanges or Crypto Currency
    • Similar content several times in different categories and/or shops
    • Miscategorization – all items must be listed in an appropriate category
    • Meaningless title & description
    • Shop test items
    • Free items and items with misleading prices
    • Items that are not for sale
    • Pre-order items, unless pre-sale approval proof can be provided
    • Illegal weapons, firearms & ammunition, stun guns, bb guns, pellet guns, blowguns, dart guns, illegal knives, and slingshots
    • Toy weapons, fake or prop weapons, 3D printed weapons, design schematics to print or self-build weapons, and similar items representing weapons (excluding certain items such as kitchen knives, scissors, archery bow and arrows, etc.)
    • Bullets (of any kind), firearm parts, stun gun parts, bb gun parts, and pellet gun parts
    • Tobacco, cigars, nicotine, e-cigarettes, cartridges for e-cigarettes, e-liquid, other smoking-cessation devices, vaporizers, and diffusers used for any type of smoking or oral inhalation, any smoking device or smoking-related item unless the item is a collectible item or approved
    • Illegal animals, exotic insects/plants/feed, or live animals; certain live feed may be approved
    • Items made from wild or exotic animal skins (even if farm-raised) and taxidermy items of wild or exotic animals, including any animal endangered or threatened under the US Endangered Species Act or anywhere else illegal; taxidermy items listed must be legal in all world regions
    • Items from dropship service networks, unless verified by newenglandconnect.com and approved with proof of dropship contract
    • Mod chips, mod chip accessories, or other devices designed to circumvent copyright protection
    • Alcohol, illegal drugs, controlled substances, and related accessories (excluding certain accessories such as smoking pipes)
    • Signal jammers or products that descramble cable and satellite signals
    • Coupons and vouchers, unless a collectible item or otherwise approved
    • Falsified orders to create or generate false feedback. All orders must be placed by an actual buyer only
    • Setting minimum purchase requirements unless an auction, group buy, or rental listing
    • Lottery tickets, fast-food game pieces, codes, and coupons for sweepstakes, raffles, or drawings offering a chance to win something
    • Unauthorized resale of tickets

Non-Disclosure, Data Usage and Ownership, Privacy, and Laws

  • Confidential Information: Includes information marked as confidential or reasonably deemed confidential. Recipients must protect and not disclose this information except as necessary for fulfilling the IO.
  • Data Usage: Restrictions on using collected data, including prohibition on repurposing data without authorization. User volunteered data is the property of the Advertiser.
  • Privacy Policies: Agency, Advertiser, and Media Company must post and adhere to privacy policies in compliance with applicable laws.
  • Compliance with Law: All parties must comply with applicable laws, ordinances, regulations, and codes.
  • Agency Use of Data: Restrictions on agency use of collected data to ensure compliance with advertiser permissions.
